Tempest warrants that products sold by it are, at the time of manufacture, free from defects in material and workmanship.  This document further details specific product categories with regard to shelf life and time in service, for which the effective warranty period applies.  See details below.

Tempest does not warrant products sold by it that have been subjected to any or all of the following conditions:

  • Any product that has been subject to negligence, accident or improper storage.
  • Any product that has been improperly installed or maintained.
  • Any product that has been operated beyond normal or recommended replacement intervals.

Tempest’s obligation under these warranties is limited to, at Tempest’s option, a) the return of the purchase price, b) repair the product, c) replace the product.  Product must be returned to Tempest for inspection.  Determination of defects in material and workmanship will be the sole judgment of Tempest.  Tempest shall not be responsible for the cost of labor for removing any product or installing any replacement product or for shipping charges for any product from or to Tempest for warranty consideration.  The aforesaid warranties are exclusive and in lieu of other warranties whether expressed, implied or statutory, including, but not by way of limitation, any warranty of merchantability for any particular purpose.
